The United Mine Workers of America (the "Union") appeals the district court's grant of summary judgment in favor of Jim Walter Resources, Inc. ("JWR"). The district court held that under the Worker Adjustment and Retraining Notification Act, 29 U.S.C. § 2102(a) ("WARN"), no combination of JWR's four separate mines constituted a "single site" of employment and the April 1992 layoffs were not "mass layoffs" under the provisions of WARN.
