The People of the State of New York, Appellant, v. Robert Murphy, Respondent

Appellate Division of the Supreme Court of the State of New York, Second Department.

November 29, 1993

Ordered that the order is reversed, on the law, that branch of the defendant's motion which was to dismiss the indictment against him is denied, and the matter is remitted to the County Court, Nassau County, for further proceedings on the indictment.

Contrary to the County Court's determination, we find that the evidence presented to the Grand Jury was legally sufficient to establish a prima facie case against the defendant...
