Justice STOUDER delivered the opinion of the court:

Following a bench trial, the defendant, George Ray Prince, was convicted of rape (Ill.Rev.Stat.1979, ch. 38, par. 11-1(a)). He was subsequently sentenced to 40 years' imprisonment. The defendant appeals.

The record shows that on August 16, 1979, the defendant was charged by information with rape. Before he could be arrested in Illinois, he was charged with aggravated sexual abuse in Texas. On July 29, 1983...
