Presently before this court is a motion for partial summary judgment filed by the Pennsylvania Association of Rehabilitation Facilities (Association). For the reasons which follow, we deny summary judgment.

The Association is a non-profit organization representing over 150 rehabilitation facilities located in Pennsylvania. On November 27, 1991, the Association filed a petition for review in our original jurisdiction1
