Michael Charles Beatty pled guilty to one count of conspiracy to commit mail fraud in violation of 18 U.S.C. §§ 371 and 1341 and to one count of mail fraud in violation of 18 U.S.C. § 1341. The district court departed upward from the otherwise applicable Sentencing Guidelines range of 27 to 33 months and sentenced Beatty to a 41-month term of imprisonment.
