Oscar Rudd has appealed a J.N.O.V. judgment in the circuit court of Harrison County dismissing his complaint following a jury verdict in his favor. Rudd had filed a complaint against Montgomery Elevator Company alleging negligent maintenance of the elevators in Gulfport Memorial Hospital resulting in a malfunctioning elevator which caused him personal injuries. Finding there was insufficient evidence to make a jury issue on liability...
