PALMER, J.

The defendant, Richard Patterson, was charged with the crime of murder in violation of General Statutes § 53a-54a (a).1 He elected to be tried by a three judge court; see General Statutes § 54-82; and was convicted as charged. At the conclusion of the trial, the defendant was sentenced to serve a term of forty-five years to be suspended after the expiration of thirty-five years. On appeal,2
