EX PARTE R.S.B.

1921499.

632 So.2d 29 (1993)

Ex parte R.S.B. (In re R.S.B. v. State of Alabama.)

Supreme Court of Alabama.

October 15, 1993.

Attorney(s) appearing for the Case

Al L. Vreeland, Tuscaloosa, for petitioner.

James H. Evans, Atty. Gen., and Gregory O. Griffin, Sr., Asst. Atty. Gen., for respondent.

HOUSTON, Justice.

We note that although the state stipulated that R.S.B. was not in need of care or rehabilitation, there was sufficient evidence from which the trial court could have determined that, because of the commission of the offenses with which he was charged, R.S.B. was, in fact, in need of care or rehabilitation.

WRIT QUASHED AS IMPROVIDENTLY GRANTED.
