This action was commenced to recover damages for personal injuries allegedly sustained by plaintiff Carmelo Azzopardi, a superintendent employed at 1457 Broadway, in an accident which occurred while he was at work. In its answer, 1457 Broadway Times Square, which is one of a number of defendants, failed to deny plaintiffs' allegation that it was the lessor of the premises, thereby effectively admitting such assertion.
