After a jury trial, defendant, Keith Edward Smith, was convicted of attempted robbery, in violation of Neb.Rev.Stat. §§ 28-201 and 28-324(1) (Reissue 1989), and use of a knife in the commission of a felony, in violation of Neb.Rev.Stat. § 28-1205 (Reissue 1989). Defendant was sentenced on April 26, 1988, to 3½ to 10 years in prison for the attempted robbery and 1½ to 3 years for the use of a knife, with the sentences to run...
