Sixteen-year-old Robert Rosen was skateboarding with friends in a residential area at night when he collided with a truck being driven by defendant Samuel Knaub. Rosen was severely injured. Knaub claimed that Robert had suddenly appeared in the street, leaving no time to avoid impact. The Rosens alleged that defendant's excessive speed caused the collision.
