Hayes Coonrod appeals an order of the Circuit Court of Kanawha County dismissing a suit in which he sought to collect from James B. Clark a judgment previously awarded against St. Albans Metal, Inc. Mr. Clark contends that Mr. Coonrod's appeal is untimely and should be dismissed because it was not filed within four months of the final judgment and no reason was given for the delay.
