Wagner was convicted of operating a gambling house in violation of Section 132.04(A)(1) of the Revised Code of General Ordinances of the City of Dayton (hereinafter referred to as "R.C.G.O."), and Kenneth D. Combs was convicted of gambling in violation of Section 132.03(A)(2) of the R.C.G.O. Wagner and Combs appeal from their convictions.
