Defendant was indicted and charged with ten felony counts stemming from his operation of a mortgage banking company and numerous real estate limited partnerships. He executed a plea agreement in which he pled guilty to one count of theft and one count of illegally conducting an enterprise. In exchange, the state agreed that if defendant received a prison sentence "[t]he state [would] recommend that ... he should not receive consecutive...
