MORGAN, J.

The State seeks discretionary review of a writ of prohibition issued by the Superior Court. We affirm.

On November 24, 1989, Maxine Butts was charged in district court with driving while under the influence of intoxicants (DWI). The parties agree that the District Court had 90 days within which to bring her to trial, CrRLJ 3.3, and that the 90-day period for trial commenced on April 6, 1990.
