On December 8, 1989, Kelvin L. Goodwin was seriously injured as a result of an explosion at Capital City Products Company ("Capital City"). Goodwin and his wife later filed a lawsuit in which they claimed that the injuries were caused by the intentional tort of Capital City, which had been Mr. Goodwin's employer on that date.
