Defendant, charged with first-degree criminal sexual conduct, MCL 750.520b(1)(b); MSA 28.788(2)(1)(b), was convicted by a jury of second-degree criminal sexual conduct, MCL 750.520c; MSA 28.788(3), and sentenced to eight to fifteen years' imprisonment. This Court in an unpublished opinion per curiam, decided September 5, 1990 (Docket No. 107638), affirmed the defendant's conviction, and on rehearing remanded the
