Plaintiff Graham Whitcombe ("Whitcombe"), an Australian citizen, came to the United States in May of 1990 on a business venture. Whitcombe and Paul Rawsthorne ("Rawsthorne"), another Australian, sought to purchase American "muscle cars" for export to and resale in Australia.
