During a valid search of a townhouse, the police caught Tommie C. Bender hiding about one ounce of cocaine base, otherwise known as crack cocaine, down a basement sewer drain pipe. The government charged Bender under 21 U.S.C. § 841(a)(1) with possession with the intent to distribute. Bender was found guilty and sentenced to twelve years in prison.
