The State of Hawaii (State) appeals the circuit court's March 18, 1992 Order Granting Defendant's Motion for a New Trial and its October 25, 1991 Order Granting Motion for Deferred Acceptance of Guilty Plea. We reverse both orders.

Defendant George M. Matyas (Matyas) was arrested for threatening a law enforcement officer with what appeared to be a gun. A search of Matyas' home resulted in the recovery of both a real gun and a toy gun.<...
