This case is a straight replication of New York v. Harris,495 U.S. 14, 110 S.Ct. 1640, 109 L.Ed.2d 13 (1990) and is completely controlled by it. The appellant, Victor Angel Torres, was convicted by a Wicomico County jury, presided over by Judge Daniel Long, of first-degree murder and the malicious destruction of property.
