This is an action in contract and tort to recover for an alleged violation of a construction loan agreement. The plaintiff-borrowers brought this action for breach of fiduciary duty, breach of contract and negligence against the defendant-lender. The plaintiffs now appeal from the allowance of the defendant's Dist./Mun. Cts. R. Civ. P., Rule 56 motion for summary judgment on all counts.
