PIESTER, United States Magistrate Judge.

Plaintiff filed this action alleging defendants failed to hire her on account of her gender in violation of: (1) the Civil Rights Act of 1964 (Title VII); (2) 42 U.S.C. § 1983; and (3) the Nebraska Fair Employment Practice Act. See Neb.Rev.Stat. §§ 48-1101 et seq. (Reissue 1988).1
