After a remand by the Supreme Court for retrial on the charge of felony murder, the prosecution appeals the trial court's denial of its motion in limine that, on retrial, the jury be instructed that the element of armed robbery necessary to establish felony murder had already been proven and that it was not an issue for the jury to decide.
