Defendant Michael J. Gaidos was arrested on May 19, 1992 and charged with theft of merchandise valued at less than one hundred dollars after having been previously convicted of theft two or more times, a violation of La.R.S. 14:67(B)(3). Defendant pled not guilty at arraignment on June 19, 1992. On August 11, 1992 defendant was found guilty as charged by the court. Defendant was subsequently sentenced to serve eighteen months at hard labor and pay...
