Plaintiff insurer has instigated a suit against the M/V CARAIBE, in rem, and the shipowner, Hapag-Lloyd AG, in personam, for the value of cargo damaged while allegedly in the care and custody of the carrier. The subrogated cargo insurer has already fully compensated the insured shipper for the damage, and now the insurer seeks to collect through subrogation an equivalent amount in money damages from defendants...
