FACTS

Following a jury trial, a judgment of conviction was entered by the Second Judicial District Court against appellant John F. Mazzan in which Mazzan was found guilty of first degree murder and sentenced to death. On appeal, this court upheld the conviction but remanded for a new penalty hearing. Mazzan v.
