Plaintiff, Bernice LaBeau, is the grandmother of a child, Mark LaBeau, who was adjudicated dependant by Judge Bradley Dakota of the Keweena Bay Indian Community Tribal Court and sent to a foster home. Mrs. LaBeau filed a Complaint against Judge Dakota objecting to the placement of the child and claiming that the Tribal Court lacks jurisdiction because neither she nor the child is Indian.
