Defendant was arrested in Albuquerque, New Mexico, after local police found crack cocaine in the vehicle in which he was a passenger. In the district court, Defendant sought to suppress the crack cocaine as the product of an unconstitutional seizure. When the trial court denied the motion, Defendant entered a conditional plea of guilty to one count of possession of cocaine base with intent to distribute in violation of 21 U.S.C. § 841(a)(1...
