Justice BILANDIC delivered the opinion of the court:

The defendant, Lawrence Andrews, was convicted in a jury trial of murder (Ill.Rev. Stat.1987, ch. 38, par. 9-1), armed robbery (Ill.Rev.Stat.1987, ch. 38, par. 18-2), and aggravated battery (Ill.Rev.Stat.1987, ch. 38, par. 12-4). The jury which convicted Andrews failed to reach a unanimous decision on whether to impose the death penalty. The trial court then sentenced the defendant to an extended term of 70 years...
