MEMORANDUM OPINION AND ORDER

HADEN, Chief Judge.

This case commenced to trial before a jury on March 9, 1993. To prove liability the Plaintiff presented four witnesses to testify to the Defendant's alleged negligence. At the close of the liability testimony the Defendant moved for directed verdict, which the Court treated as a motion for judgment as a matter of law under Rule 50(a) of the Federal Rules of Civil Procedure.
