OPINION

LEE, Justice.

Appellant entered a plea of not guilty to an indictment charging him with the offense of murder. TEX.PENAL CODE ANN. § 19.02(a)(3). He was convicted and the jury assessed punishment at forty years imprisonment. We affirm.
