MURPHY, Justice.

Appellant appeals from the denial of a pretrial application for writ of habeas corpus in which appellant attempted to bar his prosecution for the offense of driving while intoxicated (DWI). When appellant was charged with DWI, he was also cited for failure to drive in a single marked lane.
