RULING ON THE DEFENDANTS' MOTION FOR PARTIAL SUMMARY JUDGMENT AND MOTION TO STRIKE

POLOZOLA, District Judge.

This matter is before the Court on the defendants' motion for partial summary judgment and the defendants' motion to strike. For reasons which follow, the defendants' motion for partial summary judgment is granted in part, and denied in part. The defendants' motion to strike is denied as moot.
