The plaintiff, Robert Boettcher, brought suit against the defendants, Fournie Farms, Inc., and Bi-State Cold Storage, Inc., in November of 1986. Boettcher claimed that he sold his entire horseradish crop to Fournie and, pursuant to Fournie's instructions, delivered the crop to Bi-State for temporary storage.
