The facts giving rise to this appeal are not in dispute. The plaintiff, Paul Powers, was appointed a member of the Chicago Police Department on March 12, 1962. Pursuant to section 5-170 of the Illinois Pension Code (Ill.Rev.Stat.1991, ch. 108½, par. 5-170) (Code), the plaintiff contributed 1½ percent of his salary to the Policemen's Annuity and Benefit Fund (the Fund) for establishment of a widow's annuity...
