Defendant, Norman Bailey, was arrested and charged with driving while under the influence of alcohol on May 1, 1992, after he allegedly backed up and hit another car in a municipal parking lot in Edwardsville. Defendant refused to submit to a breathalyzer test after he was given the "Warning to Motorists" and he was served with a notice of statutory summary suspension.
