MALONEY, Justice.

The jury convicted Geremy Lamar Sledge of murder. The trial court assessed a forty year sentence. In seven points of error, appellant contends the trial court erred in: not charging the jury on lesser included offenses, considering hearsay and unadjudicated offenses, and overruling objections to the presentence report.
