On June 21, 1992, at approximately 10:15 p.m., two City of Montgomery police officers saw the appellant, Leslie Wayne Horn, sleeping in his motor vehicle, which was parked at the curb on a public street in a residential section of the City of Montgomery. He was arrested and charged with violating City of Montgomery municipal ordinance number 29-59. The warrant of arrest filed in the municipal court charged him specifically with "sleeping or loitering...
