In this civil action removed to this Court by defendant Tambrands pursuant to 28 U.S.C. § 1441 et seq., the Court is called upon to decide the motions for partial summary judgment filed by defendant, Tambrands, Inc. ("Tampax") with respect to (i) federal preemption of plaintiff's failure to warn claim and (ii) punitive damages.
