This case involves two appeals between the same parties that have been consolidated. In 90-CA-002409 the appellee/plaintiff-below, Arthur Boggs (hereinafter "Boggs") sued the appellant/defendant-below, Willis Davidson (hereinafter "Davidson") in a tort action for intentional assault.
