This action was tried to the Court sitting without a jury on January 6, 1993. The parties have filed their post-trial memoranda and the matter is now before the Court for decision.

Defendant Ronald K. Carroll is charged by information with two counts. Count 1 alleges that he violated Title 18, United States Code, sections 2 and 371, by aiding and by conspiring with John Christopher
