This matter is before the Court on Magistrate Judge Paul Komives' Report and Recommendation that this Court grant defendant Dan Graves' (defendant) Fed.R.Civ.P. 12(b)(6) motion for dismissal, or alternatively, defendant's Fed.R.Civ.P. 56(b) motion for summary judgment.
