The accused is suspended from the practice of law for 35 days, effective on issuance of the appellate judgment.

This is a lawyer disciplinary proceeding. The Oregon State Bar charges that the accused engaged in conduct prejudicial to the administration of justice, in violation of DR 1-102(A)(4).1 The trial panel found the accused not guilty. The Bar sought review by this court pursuant to BR 10.1, BR 10.3,
