OPINION

ROBERTSON, Justice.

The state appeals the dismissal of an indictment against Margaret Zoch, appellee. Tex.Code Crim.Proc.Ann. art. 44.01(a)(1) (Vernon Supp.1992). We reverse and remand the case for trial.
