This matter is before us on the appeal of the defendant, Rhode Island Hospital (hospital), from a Superior Court judgment. An attending physician at the hospital had performed a surgical procedure over the objections of the plaintiff, Craig L. Miller. A jury found the hospital liable for battery and awarded the plaintiff $10,000 in compensatory damages and $100 in punitive damages.1 On appeal the hospital...
