PARRO, Judge.

Plaintiff filed a devolutive appeal from a final judgment which denied plaintiff's motion for a new trial after defendant's motion for summary judgment dismissing plaintiff's claim was granted. The trial court ruled that LSA-R.S. 22:1379(8) applied retroactively to exclude coverage under a cut-through endorsement on plaintiff's insurance policy. We reverse.
