BAKER, Justice.

The State charged appellant with illegal investment. A jury found him guilty of the offense. The jury assessed a ten-year sentence and a $50,000 fine. Appellant contends the trial court should have granted a mistrial when the State referred to his failure to testify during the punishment phase.
