Arthur L. Scaggs, Jr. sued Consolidated Rail Corporation ("Conrail") for negligence pursuant to 45 U.S.C. § 51 et seq., the Federal Employers' Liability Act ("FELA"). The case was tried before a jury, which ruled in favor of Conrail. Scaggs filed a motion for judgment notwithstanding the verdict or, in the alternative, for a new trial.
