Defendant, Jerry C. Duncan, appeals from the denial of his Rule 24.035 motion without an evidentiary hearing. We affirm.

On May 24, 1991, a complaint, in the form of a sworn affidavit, was filed charging defendant with five counts of sale of a controlled substance and three counts of unlawful use of a weapon.
